The government has moved swiftly after a High Court decision threatened to overturn one of its biggest transactions, setting the stage for another chapter in the contentious Safaricom shares saga.

Attorney General Dorcas Oduor has filed an appeal against the ruling that nullified the Sh204.3 billion sale of the government’s stake in Safaricom to Vodacom. Read Full Article Here

The High Court had declared the transaction null and void, raising questions about how the government handled the sale and whether constitutional requirements were fully observed during the process.

The ruling created uncertainty around a transaction that had already been completed, with Safaricom stating that the sale was concluded in June 2026. The government, however, has maintained that the process was conducted within the law.

Oduor’s decision to challenge the judgment means the dispute will now move to the Court of Appeal, where the government will seek to overturn the High Court’s findings.

The legal battle is significant because the transaction involved the disposal of a substantial government holding in one of Kenya’s largest companies.

The government had argued that the sale was part of its broader approach to managing state assets and raising funds.

The High Court’s decision had therefore placed the transaction under renewed scrutiny, while the appeal introduces another layer to an already closely watched matter.

As the case proceeds, attention will turn to the arguments presented by the Attorney General and the response from those who challenged the sale.

For now, the Sh204.3 billion transaction remains at the centre of a major legal dispute, with the next stage set to determine whether the High Court decision will stand or be overturned.
