Speaking during a public lecture at the Catholic University of Eastern Africa, Justice Ouko explained that a petitioner challenging a presidential election must present cogent, credible and probative evidence.
According to the judge, demonstrating that irregularities occurred is only part of the legal battle.
A petitioner must also establish that the violations either substantially affected the result or fundamentally undermined the integrity of the election.
Justice Ouko emphasized that not every breach of electoral law automatically leads to nullification. Courts must examine the nature, scale and cumulative effect of alleged irregularities before determining whether an election can legally stand.
His remarks have attracted attention because Kenya’s political class is already positioning itself for the 2027 presidential contest, where electoral credibility and the handling of disputes are expected to remain major issues.
The judge also explained that the legal burden remains with the petitioner, although the evidential burden can shift during proceedings once sufficient material has been presented.
Presidential election petitions also operate under strict constitutional timelines.
A challenge must be filed within seven days of the declaration of results, while the Supreme Court must determine it within 14 days. If the election is invalidated, a fresh election is required within 60 days.
Justice Ouko stressed that speed should not replace fairness and due process, arguing that presidential disputes must ultimately be settled through evidence, law and constitutional procedures.
