Kabando has called for the resignation of the Court of Appeal judges who, according to him, aided President William Ruto’s administration to proceed with the Safaricom sale while the case challenging the process was still before the High Court.
His explosive remarks followed the High Court’s decision declaring the process unconstitutional, a development that has reopened debate over the earlier ruling by the appellate court.
“The Court of Appeal judges who aided Ruto to sell Safaricom when the case against was still ongoing at the High Court should resign in public interest,” Kabando said.
He accused the bench of acting against the public interest, using the Latin phrase “contra bonum publicum” to describe the decision.
Kabando’s intervention is expected to intensify debate over the handling of the Safaricom matter and whether the judicial process adequately protected the public interest.
The former legislator argued that the High Court ruling raises serious questions about what happened before the transaction proceeded and whether the Court of Appeal should have allowed events to move forward while the constitutional dispute remained unresolved.
With the matter now attracting renewed attention, pressure could mount for the judges involved to explain their earlier position as Kenyans seek clarity over a decision with major national and economic implications.
