Gachagua's Compensation Wish List Revealed

Former Deputy President Rigathi Gachagua is seeking an expansive compensation package worth more than Sh80 million following his impeachment, according to court documents filed in his ongoing legal battle challenging his removal from office.
The compensation claims have emerged as one of the key issues in the case, with Gachagua maintaining that his impeachment was unconstitutional and that he should be compensated for the salary, benefits and privileges he would have enjoyed had he completed his term in office until August 2027.
According to the court filings, Gachagua is seeking approximately Sh42 million in unpaid salary, calculated from the time he left office in October 2024 until the end of the current administration’s term.
His legal team argues that the impeachment deprived him of earnings he would have legitimately received if he had remained Deputy President.
Beyond the salary claim, the former Deputy President is demanding gratuity payments estimated at more than Sh22 million, alongside retirement benefits and a one-off retirement package reportedly valued at about Sh14 million.
He is also seeking a monthly pension of roughly Sh980,000, equivalent to 80 per cent of his final salary while in office.
The compensation package extends beyond cash payments. Gachagua wants the government to provide him with official retirement benefits typically accorded to former holders of the office.
These include two government-funded vehicles, fuel allowances, comprehensive medical cover for both local and overseas treatment, diplomatic passports for himself and his spouse, and access to VIP airport lounges.
Court records further indicate that he is seeking state-funded support staff, including drivers, a personal assistant, cooks and cleaners, as well as continued security protection.
His lawyers argue that these benefits are attached to the office and should not be denied despite his impeachment.

Gachagua’s legal team insists that he is not seeking reinstatement to the office but rather compensation and benefits that would place him in the position he would have occupied had the impeachment not occurred.
The case is being closely watched because of its potential implications for future impeachment proceedings and the rights of state officers removed from office.
A ruling in Gachagua’s favour could establish a major legal precedent regarding compensation for impeached public officials in Kenya.
