The decision offers Waititu a temporary reprieve after weeks of mounting pressure stemming from stringent court-imposed restrictions that had significantly limited his freedom.

In a ruling delivered on Tuesday, the court acknowledged concerns raised by the defence regarding the severity of the original bail terms.

Waititu’s legal team argued that the conditions were punitive in nature and risked undermining his constitutional right to liberty, especially given that the appeal process could take considerable time to conclude.

The judges agreed that while the seriousness of the charges facing the former governor could not be ignored, bail conditions should strike a balance between safeguarding the integrity of the judicial process and respecting an accused person’s rights.

As a result, the court revised some of the restrictions, easing the burden on Waititu pending the outcome of his appeal.

However, the court was quick to caution that the review does not amount to an acquittal or a comment on the merits of the appeal itself.

Instead, the ruling was narrowly focused on ensuring fairness and proportionality in the application of bail terms.

The judges emphasized that Waititu remains bound by strict conditions, including compliance with court directives and refraining from any actions that could interfere with witnesses or ongoing proceedings.

The bail review comes amid heightened public interest in corruption related cases involving high profile political figures.

Waititu’s legal battles have often attracted national attention, reflecting broader concerns about accountability, governance and the rule of law in Kenya.

Supporters of the former governor have welcomed the ruling as a sign of judicial fairness, while critics insist that courts must remain firm to deter corruption and abuse of office.

Prosecutors, on their part, opposed any relaxation of the bail terms, maintaining that the initial conditions were necessary given the gravity of the case and the potential risk of interference.

They warned that easing restrictions could set an undesirable precedent in cases involving senior public officials.

The High Court’s decision underscores the delicate role courts play in balancing justice, public interest, and individual rights.

As Waititu’s appeal proceeds, attention will now shift to whether the appellate court will uphold the conviction or overturn it, a verdict that could have far-reaching political and legal implications.

For now, the former Kiambu governor remains free on revised bail terms, marking yet another chapter in a case that continues to test Kenya’s judicial resolve and public confidence in the fight against corruption.
