UPDATE: Court Halts Burial of KCB Executive Rosemary Chemutai Amid Family Legal Battle
NAIROBI, Kenya — A Nairobi court has temporarily stopped the planned burial of KCB Bank executive Rosemary Chemutai Kimwatu following an urgent application filed by her husband, Kevin Migwe Kimwatu, of Linda Mwananchi.
Senior Principal Magistrate Agnes Mwangi issued the interim order at the Milimani Chief Magistrate’s Court, barring the removal of Chemutai’s remains from Lee Funeral Home.
The order effectively suspends all funeral proceedings without the explicit consent and active involvement of her husband.
The 40-year-old mother of four, who served as KCB’s Head of Data Protection, was scheduled to be interred on Saturday, August 29, at her parents’ home in Chepseon, Kericho County.

In his court filings, Migwe argued that he was sidelined by his wife’s family and her employer in the final send-off arrangements.
He contends that as her lawful husband, he holds the legal right to direct her final rites. Migwe is petitioning the court to allow him to bury Chemutai at his ancestral home in Matasia, Ngong, Kajiado County.
The legal dispute escalated after KCB Bank allegedly issued a letter to Lee Funeral Home identifying Chemutai’s sister and son as her recorded next-of-kin to facilitate the release of her body.
Migwe’s legal team pushed back, asserting that an employer lacks legal standing under employment or succession law to dictate burial arrangements to a mortuary.
Chemutai passed away on August 21 at her home in Ngong. The case is set to return to court for an inter-partes hearing on Monday, August 31, 2026, to determine how the burial process will proceed.
