The Milimani Law Courts has formally closed the burial dispute surrounding Rosemary Koech Kimwatu, KCB’s Head of Data Protection, after her husband withdrew all suits linked to her burial arrangements.
Kelvin Migwe Kimwatu had gone to court demanding a say in his wife’s final rites, but dropped the case once he confirmed she had already been laid to rest at night. He also chose not to pursue exhumation or contempt proceedings against her family and KCB, telling the court he would “leave what happened to God.”
Lawyer Felix Keaton, representing Koech’s parents, told the court the withdrawal was welcomed and confirmed there was no objection to closing the matter. He added that the family had extended an olive branch, inviting Kimwatu and the couple’s four children to visit the graveside — or the family itself — at any time.
The resolution brings to an end a case that had drawn public attention after the court intervened in a dispute pitting Kimwatu against his late wife’s relatives. The family maintained that the night burial followed Kalenjin customary practice and was never meant to sideline the widower.
Koech, 40, was found dead at her Ole Nairi home in Ngong on August 21, 2026. A post-mortem by Chief Government Pathologist Dr Johansen Oduor at Lee Funeral Home ruled the death a suicide.
Before her death, Koech had built a respected career spanning law, technology, and public policy. She joined KCB in June 2022 as Data Protection Officer, having previously served as Public Policy Manager at Safaricom, and was promoted to Head of Data Protection in June 2023, where she oversaw the bank’s compliance function.
The case’s closure now allows both families to move forward, with visitation rights preserving a path to reconciliation.
