Appearing before the court, Gachagua’s legal team argued that the impeachment exercise conducted by the National Assembly was unconstitutional, unfair, and politically orchestrated from the beginning.

The lawyers claimed Parliament imposed unreasonable timelines that denied Kenyans a genuine opportunity to submit their views on the motion seeking Gachagua’s removal.

According to the legal team, the short notice issued before public hearings made it nearly impossible for citizens across the country to effectively participate in the process.

They further alleged that some hearing venues were changed abruptly without proper communication, locking out members of the public who had intended to attend and present their opinions.

The lawyers argued that public participation is a constitutional requirement and not a mere formality.

They told the court that Parliament failed to meet the threshold expected in such a critical constitutional process involving the removal of the country’s second-highest-ranking elected leader.

Gachagua’s team also accused lawmakers of conducting what they termed as a “predetermined process,” claiming that the outcome had already been decided long before public hearings were held.

They argued that MPs ignored dissenting voices and rushed through proceedings in order to achieve a political objective.

The impeachment, which sparked intense political debate across the country, saw MPs overwhelmingly support the motion against Gachagua before the Senate later upheld the decision.

The former deputy president has since challenged the process in court, seeking to nullify both the National Assembly and Senate resolutions.

In court filings, his lawyers are seeking several declarations, including a ruling that the impeachment violated constitutional principles and that the Senate failed to ensure meaningful public participation.

They also argue that the Senate should have formed a select committee to handle the matter instead of proceeding through a plenary hearing.

The case has attracted widespread public and political attention, with legal experts saying the outcome could shape future impeachment proceedings in Kenya.

Supporters of Gachagua maintain that the process was politically motivated, while opponents insist Parliament acted within the law.

The court is expected to determine whether constitutional procedures were followed and whether the impeachment process met the legal standards required under Kenya’s Constitution.
